Terms of Service

Welcome to OmniClassify. These Terms of Service ("Terms") govern your access to and use of the OmniClassify mobile application ("App") and related services. By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

1. Acceptance of Terms

By accessing or using OmniClassify, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the App on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

OmniClassify is an AI/ML toolkit for iOS that enables users to:

• Import and manage datasets and DICOM medical imaging files
• Train machine learning models using CreateML and other frameworks
• Run inference on images, videos, and live camera feeds
• Analyze results with metrics, confusion matrices, and analytics
• Export results in various formats (JSON, CSV, PDF)
• Download datasets from HuggingFace (optional feature)

All processing occurs on your device. Your data does not leave your device unless you explicitly choose to download datasets from third-party services.

3. Eligibility

You must be at least 13 years old to use OmniClassify. If you are under 18, you represent that you have your parent's or guardian's permission to use the App. By using the App, you represent that you meet these eligibility requirements.

4. Subscription Services

4.1 Premium Subscriptions

OmniClassify offers premium subscription plans (Weekly, Monthly, and Yearly) that provide access to additional features including:

• Unlimited datasets and models (free tier has limits)
• Model training and segmentation training
• Unlimited batch processing
• Export functionality
• Advanced analytics and confusion matrices
• Remote dataset downloads from HuggingFace

4.2 Subscription Terms

• Subscriptions are billed through the Apple App Store
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• You can manage your subscription and cancel at any time through your Apple ID account settings
• Refunds are handled by Apple in accordance with Apple's refund policy
• We reserve the right to change subscription prices with 30 days' notice

4.3 Free Tier

The free tier of OmniClassify provides limited access to features:

• Maximum of 3 datasets
• Maximum of 2 models
• Limited to 50 images per inference session
• Maximum of 25 training iterations
• No export functionality
• No remote dataset downloads

5. User Responsibilities

You agree to:

• Use the App only for lawful purposes
• Not use the App to process, store, or transmit any illegal, harmful, or offensive content
• Comply with all applicable laws and regulations, including data protection laws (GDPR, HIPAA, etc.) when handling sensitive data
• Maintain the security of your device and any HuggingFace access tokens you choose to use
• Not attempt to reverse engineer, decompile, or disassemble the App
• Not use automated systems to access the App in a manner that sends more requests than a human could reasonably produce

6. Medical and Healthcare Data

Important Disclaimer: OmniClassify supports DICOM medical imaging files. However:

• OmniClassify is a general-purpose machine learning toolkit and is NOT a medical device
• The App is NOT intended for diagnostic, therapeutic, or clinical decision-making purposes
• Results from the App should NOT be used as the sole basis for medical diagnosis or treatment decisions
• You are solely responsible for ensuring compliance with HIPAA, GDPR, and other applicable healthcare data protection regulations
• We are not responsible for any medical decisions made based on App outputs
• Always consult qualified healthcare professionals for medical advice

7. Intellectual Property

The App, including its design, features, and content, is owned by Martin Kropf and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal or commercial purposes in accordance with these Terms.

You retain all rights to datasets, models, and results you create using the App. We do not claim ownership of your data or outputs.

8. Third-Party Services

OmniClassify may integrate with third-party services, including:

• HuggingFace: Optional integration for downloading datasets. Use of HuggingFace is subject to their Terms of Service and Privacy Policy.
Apple App Store: Subscriptions are processed through Apple. Your use of the App Store is subject to Apple's Terms and Conditions.

We are not responsible for the availability, accuracy, or content of third-party services. Your use of third-party services is at your own risk.

9. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

• The App will be uninterrupted, secure, or error-free
• Any defects will be corrected
• The App is free of viruses or other harmful components
• Results from machine learning models will be accurate or suitable for your purposes

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the App
• Any unauthorized access to or use of your device or data
• Any errors or omissions in the App's functionality
• Any decisions made based on App outputs

Our total liability shall not exceed the amount you paid for the App or subscription in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Martin Kropf and OmniClassify from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any law or regulation
• Your infringement of any third-party rights

12. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without cause or notice, for any reason including violation of these Terms. Upon termination:

• Your right to use the App will immediately cease
• You will not be entitled to any refund of subscription fees
• Data stored locally on your device will remain, but you may lose access to premium features

You may stop using the App at any time by uninstalling it from your device.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by:

• Posting the updated Terms on this page
• Updating the "Last Updated" date
• Providing notice through the App when possible

Your continued use of the App after changes become effective constitutes acceptance of the new Terms. If you do not agree to the changes, you must stop using the App.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Austria, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of Austria.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and OmniClassify regarding the use of the App and supersede all prior agreements and understandings.
